All custom residential blueprints, sketches, and 3D renderings drafted for our clients remain the intellectual property of BERRILLE LIVING PTY LTD, unless otherwise agreed in writing in our service contracts. Engaging our drafting services grants the client a license to build the design on the specified lot, subject to full payment of design fees, preserving design copyrights.
2. Accuracy of Site Information and Designs
The information provided on this website is for general reference purposes only. While we endeavor to keep planning guides, council policies, and CDC eligibility rules accurate and up-to-date, we do not guarantee the completeness, accuracy, or reliability of any details. Building regulations, council LEPs, and state planning codes change frequently, and you must verify rules against active policies before committing to design work.
Our custom designs depend on the accuracy of property surveys, site certificates, and easements provided by clients. Berrille Living is not liable for design errors or construction delays resulting from inaccurate survey details or concealed site conditions, such as unmapped underground pipes, rock shelves, or unstable soil structures.
3. Service Engagements and Contract Terms
Engaging Berrille Living to draft custom residential plans requires signing a formal design service agreement. This contract outlines the scope of work, drafting phases, payment schedules, engineering coordination, and approval pathways. Any pricing ballpark rates or timelines listed on this website are general guidelines only and do not form part of a binding offer or contract. We provide written fixed-price quotes only after detailed site analysis and brief review, ensuring billing clarity.
We require payment at the completion of each design phase before proceeding to the next stage or releasing finalized plans for council submission. If a project is cancelled during drafting, the client is billed for all work completed up to the cancellation date, protecting both parties.
4. Limitation of Liability and Governing Law
To the maximum extent permitted by law, BERRILLE LIVING PTY LTD is not liable for any direct, indirect, incidental, or consequential damages arising from your use of this website or reliance on its contents. This includes damages for loss of profits, building delays, council rejection fees, builder variations, or project cost overruns.
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of this website are subject to the exclusive jurisdiction of the courts of New South Wales, resolving any legal issues locally.
5. Builder Responsibilities and Client Sign-offs
Berrille Living acts as a custom residential architectural design and drafting practice. While we prepare detailed construction blueprints, specifications, and coordinate engineering surveys, we do not perform construction work. Selecting a licensed builder, managing building contract terms, and executing on-site works in accordance with our approved plans is the sole responsibility of the client. The builder must verify all dimensions on-site before beginning structural works.
We require clients to sign off on conceptual designs and final construction drawings before submission to local councils or certifiers. Any modifications requested after the final sign-off phase are subject to additional drafting fees. We communicate all billing changes transparently, ensuring a predictable and professional workflow for all projects.
